HAWAI`I EMPLOYER-UNION HEALTH BENEFITS TRUST FUND

For Employees:

  • Definition of an INVOLUNTARY TERMINATION - This is an extract from the IRS Notice 2009-27 that defines and provides examples of an involuntary termination.

  • Appealing a denial of the COBRA premium subsidy - The Department of Labor handles all appeals, not the EUTF.

  • COBRA Extended Election Notice - Since ARRA reaches back to September 2008, one component covers ex-employees who were terminated prior to February 17, 2009 but on or after September 1, 2009.  Only those who were INVOLUNTARILY TERMINATED are eligible for the COBRA premium subsidy during this period.  Other COBRA events do not qualify for this subsidy.

  • COBRA Election Notice - This component applies all employees that were terminated on or after February 17, 2009 and lost group health benefit coverage beginning on March 1, 2009.  Only those who were INVOLUNTARILY TERMINATED are eligible for the COBRA premium subsidy.

  • COBRA General Notice - This General Notice was revised to include the benefits provided by ARRA.
